Welcome to Beyond the Fence. Beyond The Fence is a trading name of ATHC Pty Ltd (“Beyond the Fence”, “we”, “our” or “us”).

This Customer Terms, Warranty & Privacy Policy governs your use of our website, products and services. By accessing our website, requesting a quotation, purchasing products, or engaging our services, you agree to be bound by these terms.

If you do not agree with these terms, please discontinue use of our website and services.

2. Definitions

• Customer means any individual, company or entity purchasing products or services from Beyond the Fence.
• Products means all fencing products, gates, gate automation systems, accessories, hardware, custom-made items and related goods supplied by Beyond the Fence.
• Services means delivery, installation, consultation, maintenance, repairs and any associated services supplied by Beyond the Fence.
• Website means www.beyondthefenceqld.com.au and all associated websites operated by Beyond the Fence.

3. Website Access & Acceptable Use

By using our website, you confirm that:

• You are at least 18 years of age.
• You are legally capable of entering into contracts.
• Any information you provide is accurate and complete.

You agree not to:

• Use the website for unlawful purposes.
• Upload viruses or malicious software.
• Attempt to gain unauthorised access to our systems.
• Copy or reproduce website content without permission.

5. Quotes & Pricing

All quotations:

• Are valid for 30 days unless otherwise stated.
• Are subject to product availability.
• May be withdrawn or amended at any time before acceptance.

Site measurements supplied by customers remain the customer’s responsibility unless Beyond the Fence has conducted an on-site measure.

Unless otherwise stated:

• Prices are displayed in Australian Dollars (AUD).
• Prices include GST.
• Freight and installation may be quoted separately.

We reserve the right to correct pricing errors at any time.

6. Orders & Payment Terms

Order Acceptance

Orders are only accepted when:

• Payment has been received; or
• A deposit has been paid and accepted by Beyond the Fence.

We reserve the right to reject or cancel orders due to: pricing errors, stock shortages, supplier issues, or suspected fraudulent activity.

Payment Methods

Accepted payment methods include Bank Transfer and PayPal. All transactions are processed securely through third-party payment providers.

Outstanding Accounts

Products remain the property of Beyond the Fence until paid for in full. Late payments may incur collection costs, legal fees, and interest charges where permitted by law.

7. Custom & Made-to-Order Products

Custom-made products include: custom gates, fabricated aluminium products, special order fencing/gates, non-standard colours, and bespoke/custom designs.

Once manufacturing has commenced:

• Orders cannot be cancelled.
• Deposits are non-refundable.
• Custom products cannot be returned unless defective under Australian Consumer Law.

8. Delivery & Freight Policy

Delivery Areas

We deliver throughout Queensland and Australia using Beyond the Fence vehicles, third-party freight providers, or courier services.

Delivery Timeframes

Delivery timeframes are estimates only. We are not responsible for delays caused by weather events, freight delays, supplier shortages, manufacturing delays, industrial action, or events beyond our reasonable control.

Site Access

Customers must ensure safe delivery access, suitable unloading areas, and clear instructions where required. Additional charges may apply where deliveries cannot be completed due to site restrictions.

Damaged Goods

Customers must inspect products upon delivery. Claims for damaged goods, missing items or incorrect products must be lodged within three (3) business days of delivery. Failure to report within this period may affect our ability to process claims.

9. Installation Conditions

Where installation services are provided, the customer is responsible for:

• Confirming property boundaries.
• Obtaining council approvals where required.
• Obtaining body corporate approvals where required.
• Ensuring underground services have been identified.

Beyond The Fence is not responsible for boundary disputes, weather or access delays, or damage caused by unknown underground services.

Installation dates are estimates only and may be adjusted due to weather, site conditions, contractor availability or scheduling requirements.

10. Returns & Refunds

Our Returns Policy operates in accordance with Australian Consumer Law.

Returns Accepted

Products may be returned where they are faulty, differ significantly from their description, or are not fit for their intended purpose.

Returns Not Accepted

We do not accept returns for: custom-made products, installed products, products ordered incorrectly by the customer, products damaged through misuse, or products altered after delivery.

Approved Returns

Approved claims may result in repair, replacement, store credit, or refund — as determined by Beyond The Fence and as required under Australian Consumer Law.

11. Warranty Coverage

PVC Fencing — Up to 30 Years

Beyond The Fence PVC fencing systems are backed by a limited warranty of up to 30 years against manufacturing defects, rot, rust, termite damage, and structural failure caused by manufacturing defects. This warranty applies when products are installed and maintained in accordance with our care and maintenance guidelines.

Aluminium Batten Fencing — Up to 10 Years

Beyond The Fence Aluminium Batten Fencing systems are backed by a limited warranty of up to 10 years against manufacturing defects, structural material failure, and premature deterioration of powder-coated finishes. This warranty applies under normal residential conditions when installed and maintained in accordance with our guidelines.

Gates & Accessories — 12 Months

Gates, hardware and accessories are covered by a 12-month warranty against manufacturing defects.

Gate Automation

Gate motors, intercoms, keypads and automation equipment are covered solely by the manufacturer’s warranty.

Warranty Exclusions

Warranties do not cover: incorrect installation, improper maintenance, accidental damage, storm or cyclone damage, impact damage, acts of nature, salt corrosion where maintenance requirements are not followed, or normal wear and tear. Warranty claims must be supported by proof of purchase.

12. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

13. Privacy & Data Collection

We are committed to protecting your privacy. Information we collect may include your name, address, email address, phone number, payment information, and website usage information.

We collect information to process orders, provide services, respond to enquiries, and improve customer experience. We do not sell customer information to third parties.

Information may be shared with freight providers, payment processors, and service providers necessary to fulfil your order. Customers may request access to their personal information at any time.

14. Intellectual Property

All website content remains the property of Beyond The Fence, including logos, images, product descriptions, marketing materials, graphics, and website design. No content may be copied, reproduced or distributed without prior written permission.

15. Limitation of Liability

To the maximum extent permitted by law, Beyond The Fence shall not be liable for indirect losses, consequential losses, lost profits, business interruption, or delays beyond our control.

Our liability is limited to repairing the product, replacing the product, or refunding the purchase price. Nothing in these Terms excludes rights available under Australian Consumer Law.

16. Force Majeure

Beyond The Fence is not liable for delays or failures caused by events beyond our reasonable control, including floods, storms, fires, pandemics, government restrictions, supply chain disruptions, or industrial disputes.

17. Website Disclaimer

While we make reasonable efforts to ensure information on our website is accurate and current, Beyond The Fence makes no guarantee that all content is free from errors or omissions. We reserve the right to update product specifications, pricing, product availability and website content without notice.

18. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
